Basic Regulations of Law 26

3 cycles of  IVF  (stimulated) by live birth.

  1. The cycles count from the moment when there is an embryo transfer. So, if white puncture (no egg) or no transferable embryo, the count is not started.
  2. The cycles covered are by live birth. So, after a birth, the couple is entitled to 3 new trials.

6 cycles of  IVF  (natural) per live birth.

  2. The cycles covered are by live birth. So, after a birth, the couple is entitled to 6 new trials.

The ICSI  (intracytoplasmic sperm injection) is covered in treatment costs, so essential by the physician.

The  PGD  (preimplantation diagnosis) is covered in the costs of treatments, so essential according to the doctor.

The  hatching  (assistance to the hatching of the embryo), is covered in the costs of the treatments, so essential according to the doctor.

TESA  (testicular sperm aspiration) is covered in the costs of treatment, if necessary according to the doctor.

PESA  (percutaneous aspiration of epididymal spermatozoa) is covered in the costs of treatment, if necessary according to the doctor.

IAC  (artificial insemination with spouse) or IAD (donor), if necessary, the doctor could decide to proceed to more insemination if he thinks it necessary.

Sperm donation  : the government only covers the flakes of anonymous donors. A couple who decides to go with a donor in “Open ID” (known identity), will have to cover the costs themselves.

Diagnostic tests  : all tests used to detect infertility are covered when they are carried out in the public sector. Clinics still offer a lot of private services, but they do not need to be used. It’s up to the couple to make the decision.

 March 2006 Special Consultations

This bill was introduced following the implementation of a federal law in March 2004, which regulated the regulation of assisted reproduction clinics, which prohibited unacceptable practices (human cloning, choice of sex, remuneration of surrogates, and commercialization of human reproductive material). The government requested a reference to the Court of Appeal because it held that the regulation of health care was under provincial jurisdiction.

It focused on legislating AHR treatments to reduce the rate of multiple births, which in turn increases premature birth (54%) and low birth weight babies (51%). In no time was there a question of reimbursement of the costs of treatment.

The government wanted to pass a law and then it would develop the regulations. The bill was not passed.
